Terms of Service

These Terms of Service (“Terms”) govern your use of the Tellis mobile app and the website at tellis-app.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

2. What Tellis is

Tellis helps students find study spaces, see how busy they are, check in on-site, keep learning statistics, and connect with other students (profiles, groups, chats, a location pinboard, photos and reviews of study spaces). Features may change, be added or be removed over time.

3. Eligibility and age

You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you provide during registration is accurate. Each person may hold only one account.

4. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at [email protected] if you believe your account has been compromised. You may delete your account at any time from within the app (Settings → Delete account); this permanently removes your personal data as described in our Privacy Policy.

5. Acceptable use

To keep Tellis useful and safe, you agree not to:

• post content that is unlawful, hateful, harassing, threatening, defamatory, sexually explicit, or otherwise objectionable;
• bully, harass, impersonate, stalk or threaten other people;
• upload photos of other people without their consent, or content you do not have the right to share;
• submit false check-ins, fake study spaces, spam, or manipulate points, rankings or occupancy data;
• attempt to access other users’ accounts or data, disrupt the Service, or circumvent its security;
• use the Service for any illegal purpose or in violation of applicable law.

6. Your content

You keep ownership of the content you create (for example photos, reviews, profile information, group and pinboard posts). By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to store, display and distribute that content within the Service for the purpose of operating and providing it. This licence ends when you delete the content or your account, except for copies retained briefly in backups or where other users have already saved or reshared content, and except where we must keep records to comply with the law.

You are solely responsible for the content you post and confirm that you have the rights to share it. Photos are re-encoded on your device before upload, which removes embedded metadata such as GPS location.

7. Objectionable content and moderation — zero tolerance

There is no tolerance for objectionable content or abusive behaviour on Tellis. You can report content or other users, and block users, directly in the app. We may review reported content and, at our discretion, remove content, hide it automatically once it is reported by enough users, and suspend or terminate accounts that violate these Terms — including, where warranted, without prior notice. We aim to act on reports of objectionable content and remove it, and to eject the users responsible, within 24 hours.

8. Location features

Location-based features (such as verifying a check-in) run on your device. Your precise GPS coordinates are not transmitted to or stored on our servers; the server only receives the result of an on-device check. See the Privacy Policy for details. You can disable location access at any time in your device settings; some features will then be unavailable.

9. Fees

The Service is currently provided free of charge. There are no in-app purchases or subscriptions. If we introduce paid features in the future, they will be clearly described and offered through the applicable app-store payment system, and separate terms may apply.

10. Intellectual property

The Tellis name, logo, app, website, design and software are owned by us and protected by law. These Terms do not grant you any rights in them beyond using the Service as intended.

11. Third-party services

The Service relies on third-party providers (for example cloud hosting, database and authentication, object storage, and map data). Your use of the Service may be subject to their terms where applicable. We are not responsible for third-party services we do not control.

12. Availability and “as is”

We work to keep the Service available and reliable, but we provide it “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that information such as occupancy estimates or community-provided details is always accurate.

13. Limitation of liability

To the extent permitted by applicable law, we are liable without limitation only for intent and gross negligence, and for injury to life, body or health. For slight negligence, we are liable only for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and only up to the foreseeable, typical damage. Any further liability is excluded. Mandatory statutory liability, including under product-liability law, remains unaffected.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially or repeatedly breach these Terms, or where required by law. Sections that by their nature should survive termination (such as ownership, liability and governing law) continue to apply.

15. Changes to these Terms

We may update these Terms, for example when features change or for legal reasons. If changes are material, we will notify you within the app or by other appropriate means. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.

17. Apple App Store

If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
